Tesla Authorized for Commercial Driverless Operations in Texas
Texas authorized Tesla to operate driverless vehicles commercially under a new self-certification law that took effect May 28, 2026, with the company certifying its robotaxi software as Level 4. The same day, Cybercab units began autonomously driving out of Gigafactory Texas after mass production started in April, advancing the company's ride-hailing plans.

The legislation establishes a statewide regulatory framework that requires authorization from the Texas Department of Motor Vehicles for companies to operate automated vehicles commercially on Texas roads. It covers driverless or SAE Level 4 and above operations for passenger transport, including Robotaxi services, or freight.
On the same day, Tesla CEO Elon Musk shared a video of Cybercab units autonomously driving off the property at Gigafactory Texas.
Under the framework, Tesla and other companies can self-certify their vehicles and technology. They must operate in compliance with Texas traffic laws, maintain proper registration, title, and insurance, use compliant automated driving systems, and record onboard activity while handling system failures and glitches safely. The authorization allows companies to utilize their own processes to determine if their vehicles are ready to operate without drivers.
This rule expedites the entire approval process by keeping agencies out of a usually long, lengthy, and frustrating task that is essential to technological advancements. The new authorization was first reported by James Stephenson on X. Stephenson noted that Tesla has officially self-certified the software running on its robotaxis as Level 4.
